1. What you’re signing up for
Trades Terminal is a software tool. We give you a workspace for charting, order entry, journaling, multi-account copy, and rule enforcement against your prop-firm accounts. We connect to your broker on your behalf when you authorize us to. We don’t hold your money, we don’t take custody of your account, and we don’t place trades you didn’t initiate.
By creating an account, you agree to these Terms, our Privacy Policy, and our Risk Disclosure. If you don’t agree, don’t use the product.
2. Who can use it
You need to be at least 18 years old and legally able to enter into this contract where you live. You’re responsible for making sure trading futures or forex is legal for you to do from your country and your state or province.
One human, one account. Don’t share logins. Don’t create accounts on behalf of someone else without their permission and ours.
3. Your account, your responsibility
You’re responsible for keeping your sign-in credentials safe, for every action taken under your account, and for the broker credentials you give us to connect with on your behalf. We do our best with security on our side (see Privacy), but if your password leaks because of something on your end, that’s on you.
4. What we charge
Pricing is on the pricing page and we update it when it changes. We bill monthly or annually depending on the plan you pick. We use Stripe for payments — your card details never touch our servers.
Refunds. If something we shipped breaks your workflow inside the first 14 days of a paid plan, email hello@tradesterminal.com and we’ll refund you. After that we don’t do pro-rated refunds for unused time on a billing cycle, but you can cancel any time and keep your plan through the end of the cycle you already paid for.
Price changes.If we raise the price on a plan you’re already on, we’ll email you at least 30 days ahead. You can cancel before the new price kicks in and we won’t charge you the higher amount.
5. What we do NOT do
- We don’t give financial, investment, tax, or legal advice. Nothing in the product is a recommendation to buy, sell, or hold any instrument.
- We don’t guarantee execution. We send your orders to your broker; what the broker does with them is between you and the broker.
- We don’t guarantee uptime. We try hard, we publish a status page, but trading software can fail and you should have a fallback plan with your broker directly.
- We don’t guarantee you’ll pass a prop-firm evaluation, keep a funded account, or make money. See the Risk Disclosure.
6. Acceptable use
Don’t do these things with Trades Terminal:
- Reverse-engineer the product, scrape it, or build a competing service from data we exposed for your use.
- Use it to evade a prop firm’s rules, hide identity between accounts, or cooperate with another trader to defeat a one-account-per-trader policy.
- Use it for any market manipulation, wash trading, spoofing, or anything else your broker or the relevant exchange prohibits.
- Resell market data, broker-feed data, or any broker-connected output to a third party.
- Use the AI features to generate content that violates a third party’s rights, is harassing, or that you intend to pass off as financial advice to someone else.
Break these and we can suspend or terminate your account without a refund.
7. Your data, our data
You own everything you put in — your trades, your journal entries, your saved layouts, your AI prompts. We own the product itself, the design, the code, the marketing copy. See the Privacy Policy for what we collect, why, and how to get it out or delete it.
If you give us feedback or a bug report, we can use it to improve the product without owing you anything for it.
8. Disclaimers
The product is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We don’t warrant that the product will be uninterrupted, error-free, secure against every threat, or that the results obtained from it will be accurate or reliable.
9. Limitation of liability
To the maximum extent permitted by law, Trades Terminal, its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, trading losses, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of (or inability to use) the product, even if we’ve been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the product is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.
Some jurisdictions don’t allow the exclusion of certain warranties or the limitation of certain damages. In those places, some of the above may not apply to you, and you may have additional rights. The limitations apply to the maximum extent permitted by law where you live.
10. Indemnification
You agree to defend, indemnify, and hold harmless Trades Terminal and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the product, your breach of these Terms, your violation of any law or third-party right, or any trade you placed (or didn’t place) through the product.
11. Suspension and termination
You can close your account any time from the settings page. We can suspend or terminate your account if you break these Terms, if your payment fails and isn’t cured, or if we need to for legal or security reasons. We’ll give you reasonable notice when we can.
On termination, your access stops, your stored data is retained per the schedule in the Privacy Policy, and the sections of these Terms that should reasonably survive (Disclaimers, Limitation of Liability, Indemnification, Governing Law) survive.
12. Changes to these Terms
We can change these Terms — software products evolve. If we make a material change we’ll bump the “Last updated” date at the top and notify you in-app or by email. Continuing to use the product after the change means you accept the new Terms. If you don’t accept, close your account.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute that can’t be resolved informally goes to binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, seated in Wilmington, Delaware. You and Trades Terminal both waive any right to a jury trial and to participate in a class action.
Nothing in this section stops either party from seeking injunctive relief in a court of competent jurisdiction for intellectual-property infringement or unauthorized access. If the class-action waiver is held unenforceable for any claim, that claim alone is severed and litigated in the state or federal courts of Delaware; the rest of the arbitration agreement stands.
14. Miscellaneous
These Terms (plus the Privacy Policy and Risk Disclosure) are the whole agreement between you and us about the product. If a court strikes a piece of these Terms, the rest stay in effect. Failure to enforce a right isn’t a waiver of it. You can’t assign your account to someone else without our permission; we can assign these Terms in connection with a merger, acquisition, or sale.
